egr valve cut off

the last owner of my car cut off the egr tubing(the one that is coiled)and just put a 3" length of rubber hose between the ends. pretty much bypassing the coiled tube so he could easily replace the starter. will this cause any harm to the engine or will is effect the emissions test? he couldn't take it off because of the size of the fitting connected to the engine and how much the fitting was torqued down. does anyone have any suggestions?
 
The only problem I see is that the rubber won`t lst as long as the sleel line . Besides that all should be fine .
 
8) part of the reason for the long tubing run is so the exhaust gasses can cool some before they enter the intake tract.
